1. Contest Description. The “Submit Your Comic Book Idea and Win” Contest (“Contest”) consist of (a) a webisode competition (“Webisode Competition”) which includes a skill-based component (“Skill Component”) and a voting and rating of the webisode component (“Selection Component”); and (b) a sweepstakes (the “Sweepstakes”). For the purpose of this Contest, all times refer to Pacific Time, and Sponsor’s computer is the official timekeeping device. PARTICIPANTS IN THIS CONTEST IS SUBJECT AT ALL TIMES TO COMPLIANCE WITH THESE OFFICIAL RULES AND WITH ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS.
2. Dates/Terms/Eligibility. This contest shall begin midnight, July 20, 2007 through midnight, January 20, 2007 or upon receipt of the Five Thousandth (5000th) submission, whichever comes first. Comflix Studios, Inc. (the "Sponsor") may change the dates and/or terms of the Contest without prior notice. Any material changes will be posted on its website (www.comflix.net). Whether or not an entry was timely received shall be at the sole discretion of Comflix. The Contest is open to legal U.S. residents, 18 years of age and older, residing in the 48 continental United States. There is no purchase necessary to enter or win. Employees or agents of Comflix, as well as members of the same household of any such employee or agent, may not participate.
3. Entries. All entries shall be in Flash Video (flv). Bit rate should be no higher than 768k. Each entry shall be at least 15 seconds long and no longer than two (2) minutes. No entry can exceed 110 megabytes in size. Each entry must be in English. No entry may contain any person other than the entrant, may refer to any real person, alive or dead, other than the entrant, and contain any voices other than the entrant. The entry and all intellectual property contained within the entry (including but not limited to music or artwork) must belong to the entrant or be in the public domain.
Each entry must not contain or depict any objectionable, unlawful, defamatory, obscene, sexually explicit, threatening, abusive, harassing, hateful, discriminatory, vulgar, racially or ethnically-motivated, invasive of another's privacy, or any other objectionable material or gesture or is otherwise unfit for publication / posting / uploading, as determined by Comflix Studios, Inc. in it's sole and absolute discretion; or violate any copyright, trademark, privacy, publicity or other propriety right of any person or entity. Each entry must not contain the last name, phone number(s), address, or email address of any person including entrant. Each entry shall not contain any material t hat would give or threaten to give rise to criminal or civil liability or encourages conduct or provides instructional information about illegal activities.
Each entrant is limited to five (5) entries.
Comflix Studios, Inc., shall, in its sole discretion, determine if an entry is volatile of any of the terms or prohibitions and shall, in its sole discretion, reject any such entry.
All submissions become the sole property of Comflix Studios, Inc. Should Comflix Studios, Inc., decide to develop any entry, it will pay to the creator $500.00 and, in its sole discretion, up to Five Percent (5%) of all net profits resulting from development of the entry.
4. Prizes. There shall be only one winner. The winner shall be selected by a combination of user votes and Comflix Studios, Inc. executive staff. Comflix Studios, Inc. shall in its sole discretion approve the winning selection. The winner will be notified by email or mail or phone one (1) week after the drawing date and if the potential winner cannot be reached after a reasonable effort has been exerted, is found ineligible, or does not abide by official rules or if prize notification is returned undeliverable, the potential winner will be disqualified. The next runner up, subject to the same terms and conditions, shall be notified as the winner. All sales, prize and other taxes, gratuities and any other incidentals associated with the prize are the sole responsibility of the prizewinner. Prizes are not transferable or exchangeable. The Prize consists of turning the winning submission into a Comflix episode/webisode. The date, time, location, and manner of the award shall be at the sole discretion of Comflix. Sponsor reserves the right, at any time, and without explanation, to substitute a cash prize of One Thousand Dollars ($1,000.00). Prizes unclaimed after 45 days become the property of Comflix Studios, Inc.. Comflix Studios, Inc. assumes no responsibility or liability for damages, loss or injury resulting from acceptance or use of the prize.
5. Conditions/Restrictions. Each winner will be required to produce identification satisfactory to the Sponsor. Each winner will be required to sign an affidavit of eligibility and release, including a publicity release, as prepared by the Sponsor prior to receiving the prize. Each winner will be responsible for any taxes or fees that result from the receipt and/or use of their prize and may receive an IRS Form 1099-Misc. The Contest is void where prohibited by law. Anyone using fraudulent means to participate and/or win the Contest shall be disqualified. Anyone submitting a virus, bug, worm, or other malicious hardware, as determined by Comflix Studios, Inc., shall be disqualified.
6. Restrictions. Comflix is not responsible for errors, problems or delays in the mail, email, or telephone systems that may prevent entries from reaching Comflix. Decisions of Comflix management are final. All contest entries will become the property of Comflix.
7. Release and Indemnification. In exchange for the right to participate in the Contest, each participant agrees to release and indemnify the Comflix Studios, Inc., and its officers, directors, agents, parent companies, subsidiaries and employees (the "Released Parties"), from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that arise out of the participant's participation in the Contest.
8. Rules. Any violation of these rules will result in disqualification. Copies of these rules are available at the Sponsor's website www. Comflix.net.
Special Internet Rules
1. Game and contest participants using the Internet must provide a valid email address. Limit five entries per email address. Each entrant is limited to five entries as well.
2. Comflix Studios, Inc. and sponsors not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by Comflix, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate.
3. Comflix reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of Comflix, corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any promotion, game or contest. Comflix, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.
